1. Introduction & Definitions

Welcome to Taste Flow (the "Platform"), a QR-based food ordering Software-as-a-Service (SaaS) platform owned and operated by My Click Technologies Company (the "Company", "we"), based in Al-Khobar, Kingdom of Saudi Arabia.

  • "Restaurant" or "Merchant": any food establishment registered on the Platform to display its menu and receive orders.
  • "Customer": any person using the Platform to browse menus or place orders.
  • "Services": all features provided through the Platform, including digital menus, QR ordering, online payments, loyalty programs, and Kitchen Display Systems (KDS).

By using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use.

2. Eligibility & Registration

  • You must be 18 years or older to create a merchant account.
  • Restaurants must provide accurate, up-to-date information, including Commercial Registration, municipal license, and VAT number (where applicable).
  • Restaurants are responsible for the confidentiality of their credentials and all activity under their account.
  • The Company reserves the right to refuse or suspend any account violating these Terms or applicable Saudi regulations.

3. Scope of Service

  • The Platform provides the technical infrastructure for menus, ordering, and payments; it is not a party to the contractual relationship between the Restaurant and the Customer.
  • The Restaurant is solely responsible for food quality and safety, pricing and description accuracy, order fulfillment, and compliance with SFDA and municipal requirements.
  • Services may be offered in different subscription tiers, as described on the pricing page.

4. Subscriptions & Fees

  • Subscription fees are paid in advance according to the selected plan (monthly or annual).
  • All prices are in Saudi Riyals.
  • Fees for used periods are non-refundable unless required by law.
  • The Company may modify pricing with at least 30 days' prior notice.

5. Payments

  • Customer payments are processed through payment providers licensed by the Saudi Central Bank (SAMA), supporting Mada, Visa/Mastercard, Apple Pay, and STC Pay.
  • The Platform does not store card data on its servers; processing is handled by the payment provider under PCI-DSS standards.
  • Order refunds are subject to each restaurant's policy, in line with the Saudi E-Commerce Law and consumer protection regulations.

6. Acceptable Use

Users must not:

  • Use the Platform for any purpose that violates Saudi laws or public morals.
  • Attempt to hack, disrupt, or gain unauthorized access to the Platform or others' data.
  • Post misleading, offensive, or IP-infringing content.
  • Resell or sublicense the Services without the Company's written consent.

7. Intellectual Property

  • All intellectual property rights in the Platform (code, design, trademarks) belong to My Click Technologies Company.
  • Restaurants retain ownership of their content (logos, dish photos, descriptions) and grant the Company a non-exclusive license to display it for the purpose of operating the Service.

8. Limitation of Liability

  • Services are provided "as is" with reasonable care to ensure availability, without warranty of uninterrupted or error-free operation.
  • The Company is not liable for indirect damages or loss of profits arising from use of the Platform.
  • The Company's total liability shall not exceed the subscription fees paid in the twelve (12) months preceding the claim.

9. Suspension & Termination

  • Restaurants may cancel their subscription at any time from the dashboard; the subscription remains active until the end of the paid period.
  • The Company may suspend or terminate accounts immediately for breach of these Terms or misuse of the Platform.
  • Upon termination, restaurants may export their data within 30 days before deletion in accordance with the data retention policy.

10. Changes to These Terms

The Company may update these Terms from time to time. Users will be notified of material changes via email or in-platform notice before they take effect.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Saudi courts and judicial authorities have exclusive jurisdiction over any dispute, with amicable resolution sought first.
